Accommodation Terms and Conditions

Article 1 (Scope of Application)

1. Accommodation contracts and any related contracts concluded between Guest House “MIYAJIMA tonbo-AND” (hereinafter referred to as “the Guesthouse”) and its guests shall be governed by these Accommodation Terms and Conditions (hereinafter referred to as “these Terms”). Matters not specified herein shall be governed by applicable laws and regulations or generally established customs.

2. Notwithstanding the preceding paragraph, if the Guesthouse agrees to special terms not contrary to laws, regulations, or established customs, such special terms shall take precedence.

 

Article 2 (Application for Accommodation Contract)

1. Persons wishing to apply for an accommodation contract with the Guesthouse shall submit the following information through the Guesthouse's designated reservation site, check-in system, or other means:

(1) Full name, email address, phone number, address, nationality, passport number, gender, date of birth, occupation, and at check-in, a handwritten signature by the guest for all guests, including the representative guest.

(2) Dates of stay, length of stay, estimated arrival time, and departure date.

(3) For foreign guests without a domestic address in Japan: passport data (image).

(4) Other information deemed necessary by the Guesthouse

2. Registration of the application information in the check-in system as described in the preceding paragraph shall serve as a substitute for entry in the guest register required under Article 6 of the Hotel Business Act.

3. If a guest requests to extend their stay beyond the date specified in Item 2 of the preceding paragraph during their stay, the Guesthouse shall treat this request as a new application for a lodging contract at the Guesthouse the request is made.

4. The Guesthouse shall not accept reservations for stays consisting solely of persons under 18 years of age (including high school students).

 

Article 3 (Establishment of Accommodation Contract)

1. The accommodation contract shall be established when the Guesthouse accepts the application described in the preceding article.

2. When applying for an accommodation contract, the full accommodation fee must be paid in advance through the reservation site designated by the Guesthouse by the date specified by the Guesthouse.

3. If the accommodation fee specified in the preceding paragraph is not paid by the date designated by the Guesthouse, the accommodation contract shall become void.

 

Article 4 (Refusal to Conclude Accommodation Contract)

The Guesthouse may refuse an accommodation contract in the following cases:

(1) When the application for lodging does not comply with these Terms and Conditions

(2) When no guest rooms are available due to full occupancy

(3) When the Guesthouse determines that the person seeking lodging is likely to engage in conduct contrary to laws and regulations, public order, or public morals in connection with the lodging

(4) When the Guesthouse determines that the person seeking lodging falls under any of the following categories or is likely to fall under any of the following categories

a. Organized crime groups, members of organized crime groups, quasi-members of organized crime groups, associates of organized crime groups, or other antisocial forces as defined by the Act on Prevention of Unjust Acts by Organized Crime Group Members

b. Corporations or other organizations whose business activities are controlled by organized crime groups or members thereof

c. Corporations whose officers include individuals who are members of organized crime groups

(5) When the person seeking lodging is a patient with a specified infectious disease, etc.

(6) When violent demands are made regarding the accommodation, or when demands are made that exceed a reasonable burden

(7) When repeated demands are made for unreasonable discounts on accommodation fees, demands are made for items that are difficult to fulfill, or when excessive demands are made over a long period of time or while scolding, thereby causing excessive physical or mental strain on employees

(8) When accommodation cannot be provided due to natural disasters, facility malfunctions, or other unavoidable reasons

 

Article 5 (Cancellation by Guest)

1. Guests may cancel the lodging contract by notifying the Guesthouse.

2. Should a guest cancel all or part of the lodging contract for reasons attributable to the guest, the Guesthouse shall charge the cancellation fee listed in Appendix 1.

3. If a guest fails to arrive by 11:00 PM on the scheduled arrival date without prior notification, the Guesthouse may deem the accommodation contract terminated by the guest. In such cases, the cancellation fee specified in the preceding paragraph shall be charged.

 

Article 6 (Termination by the Guesthouse)

1. The Guesthouse may terminate the accommodation contract in the following cases:

(1) When the guest commits acts related to the stay that violate laws, public order, or public morals, or when the guest is deemed likely to commit such acts.

(2) When the circumstances described in Article 4 arise.

(3) When the guest violates these Terms and Conditions or the usage rules established by the Guesthouse.

(4) When the guest violates prohibited acts specified in the Guesthouse's usage rules, such as smoking in bed, tampering with firefighting equipment, etc.

2. When the Guesthouse terminates the lodging contract based on the provisions of the preceding paragraph, no charges shall be levied for lodging services or other services not yet provided to the guest. In such cases, a cancellation fee shall be charged as specified in Appendix 1.

 

Article 7 (Registration of Identity Verification Records)

Guests shall register an identity verification record on the day of lodging by having their photograph taken via the camera on their own device using the Guesthouse’s designated check-in system.

 

Article 8 (Room Usage Hours)

1. Guests may use their rooms from 3:00 PM on the check-in date until 10:00 AM on the check-out date. For consecutive stays, rooms may be used throughout the day, excluding the arrival and departure dates.

2. If a guest wishes to use the room outside the hours specified in the preceding paragraph, an additional fee of ¥3,000 per hour will be charged. However, depending on reservation status, we may be unable to accommodate extended usage.

3. Access codes and other unlocking permissions provided to guests are valid only during the usage hours specified in Paragraph 1.

 

Article 9 (Compliance with Usage Rules)

Guests shall comply with the usage rules of the Guesthouse, as listed at the end of these Terms and Conditions, while on the premises.

 

Article 10 (Payment of Fees)

1. Payment for accommodation fees, etc., must be made in advance in Japanese yen through the reservation site designated by the Guesthouse. Payment methods include credit cards, Apple Pay, Google Pay, and PayPal. On-site payments are not accepted.

2. Even if a guest chooses not to stay after the Guesthouse has provided the room and made it available for use, the accommodation fee will be charged.

 

Article 11 (Room Cleaning)

1. For consecutive stays, the Guesthouse will not perform daily cleaning.

2. For stays of 4 nights or more, room cleaning will be performed once every 3 days. On non-cleaning days, towel and other linen replacements and amenity replenishments will not be provided.

3. Notwithstanding the preceding paragraph, guests may not refuse cleaning if the Guesthouse deems it necessary for hygiene management.

 

Article 12 (Hotel Liability)

The Guesthouse shall compensate guests for damages incurred due to the performance or non-performance of the lodging contract and related contracts. However, this shall not apply if the Guesthouse is not at fault.

 

Article 13 (Handling When Contracted Room Cannot Be Provided)

If the Guesthouse cannot provide the contracted room to the guest due to reasons attributable to the Guesthouse, the Guesthouse shall pay the guest compensation equivalent to the penalty fee, and such compensation shall be applied toward the amount of damages.

 

Article 14 (Handling of Luggage, Valuables, and Lost Items)

1. The Guesthouse shall not be liable for any loss, damage, or destruction of items, cash, or valuables brought into the Guesthouse by the guest.

2. The Guesthouse does not provide luggage storage before check-in or after check-out.

3. If a guest's luggage or personal belongings are left behind at the Guesthouse after checkout (hereinafter referred to as “lost property”), and the owner is identified, the Guesthouse shall contact the owner and seek their instructions. In such cases, if the owner requests shipment, the shipping cost shall be collect on delivery or otherwise borne by the owner.

4. The Guesthouse does not provide long-term storage. If, after 7 days from the date the Guesthouse contacted the owner, no shipping instructions are received from the owner or the owner cannot be identified, the Guesthouse will report the lost item to the police station and take other necessary actions in accordance with the Lost Property Act.

 

Article 15 (Guest Liability)

If the Guesthouse suffers damage due to a guest's intentional act or negligence, the guest shall compensate the Guesthouse for such damage.

 

Article 16 (Personal Information)

The Guesthouse shall handle personal information obtained from guests in accordance with its separately established Privacy Policy. The Privacy Policy can be viewed on the Guesthouse’s website.

 

Article 17 (Language)

The Japanese text of these Terms and Conditions shall be the authentic version. Translations into other languages are provided for reference only. In the event of any inconsistency or conflict between the Japanese Terms and Conditions and any translated version, the Japanese Terms and Conditions shall prevail in all respects.

 

Article 18 (Governing Law and Jurisdiction)

1. These Terms shall be governed by Japanese law.

2. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the Hiroshima District Court as the court of first instance.

 

Article 19 (Amendment of Terms)

The Guesthouse may amend these Terms at its discretion. In such cases, the Guesthouse shall announce the amendments by posting them on the Guesthouse’s website or by other means deemed appropriate by the Guesthouse. The amended Terms shall become effective on the effective date specified at the time of announcement.

Rules of Use

 

Guesthouse “MIYAJIMA tonbo-AND” (hereinafter referred to as “the Guesthouse”) has established the following rules of use based on Article 9 of the Accommodation Terms and Conditions to ensure guests enjoy a safe and comfortable stay. We kindly ask for your cooperation. Failure to comply with these rules may result in termination of the accommodation contract pursuant to Article 6 of the Accommodation Terms and Conditions.

 

1. Fire Prevention and Safety

(1) Smoking, including electronic cigarettes, is prohibited throughout the entire facility and its grounds.

(2) Entry into areas other than those permitted by the facility (such as staff-only areas) is prohibited.

(3) The facility assumes no responsibility whatsoever for any disputes arising between guests.

 

2. Prohibited Activities

(1) Entry into the Guesthouse by persons other than those registered at the time of reservation.

(2) Gambling or any behavior that disturbs public order within the Guesthouse or on the premises.

(3) Loud voices, singing, or noisy behavior that disturbs nearby residents (especially after 9:00 PM).

(4) Using the Guesthouse for purposes other than lodging without the Guesthouse's permission.

(5) Distributing or posting advertisements or promotional materials, selling goods, soliciting, conducting business activities, distributing flyers, conducting signature campaigns, etc., without the Guesthouse's permission.

(6) Using any facility or item within the premises for purposes other than its intended use, or moving, altering, or removing any facility or item from the premises without permission (Damage, breakage, or loss will be charged at actual cost.)

(7) Touching items for sale or artworks within the premises (Damage, breakage, or loss will be charged at the full retail price.)

(8) Bringing in explosives, volatile oils, other dangerous substances, or items prohibited by law

(9) Using the premises in a state where significantly unclean body or clothing may cause nuisance to the facility or other guests

(10) Any discriminatory remarks or actions, slander, harassment, or conduct causing anxiety to other guests, nearby residents, or staff of affiliated businesses

(11) Unauthorized parties, events, or similar gatherings

(12) Any other conduct deemed inappropriate by the facility

 

3. Information

The use of the Guesthouse’s trade name, Guesthouse“MIYAJIMA tonbo-AND” (Japanese: 宮島とんぼ庵), by any third party other than the facility is prohibited.

 

4. Waste Separation

Please properly separate waste generated within the facility according to the instructions provided by the Guesthouse.

 

5. Security Cameras

For your safety and security, security cameras are installed in common areas such as entrances and exits. Private spaces such as guest rooms and bathrooms are not recorded.
